Your role as a tenant

In most Colorado rentals, pest problems inside walls, attics and crawl spaces are the owner's responsibility, and the owner's insurance and contractors handle the building. Colorado's habitability law requires landlords to address serious conditions after receiving notice. Your job is to report clearly and in writing, and to protect your own belongings and health.

A specific report, with the room, the wall, the time and any flies, is far more useful than a general complaint about a bad smell, and it creates a record if the problem drags on.

Before you send it

What to expect

First response
A reasonable landlord acknowledges the report and arranges an inspection within a few days.
Access
Landlords usually must give notice before entering, except in emergencies; check your lease.
Your belongings
Damage to your things is generally a renters insurance matter, not the landlord's.
Records
Keep every message, photo and date in one place in case the problem continues.

If nothing happens

Follow up in writing after a few days, repeating the details and noting any changes such as flies or stains. Colorado has tenant resources that explain your rights under the state's habitability law if a serious problem is not addressed.

Common questions

Can I withhold rent until it is fixed?

Colorado law sets specific procedures for tenants when landlords do not fix serious problems. Check current rules or get tenant advice before withholding rent.

Should I report flies separately?

Include them in the same report. Flies help locate the source and show the problem is active.
